Car Rental Agreement Terms and Conditions

Car Rental Agreement Between Waryam Singh Pty ltd and Renter is subject to the following terms and conditions:
Waryam Singh Pty Ltd and Renter may also be referred to as “Party” in the singular and “Parties” in the plural.
Rental Period (If End Date not specified:)
The Parties agrees that this Agreement terminates only upon receiving two weeks’ notice from the Renter to Waryam Singh Pty Ltd by sending an termination notice email to: admin@sahibgroup.com.au
Rental Period ( If End Date specified:)
If renter wants to extend the return date of the vehicle The Parties agrees that it can be done by sending request via email to: admin@sahibgroup.com.au If this Agreement is terminated prior to the End Date: Renter needs to notify two weeks in advance if they decide to return to the car by sending request via email to: admin@sahibgroup.com.au and all the dues must be cleared.
Rental Fees or Bond Deposit:
  1. Waryam Singh Pty Ltd shall retain this deposit to be used, in the event of loss of or damage to the Vehicle during the term of this Agreement, to defray fully or partially the cost of necessary repairs, replacement or to pay any tolls or fines.
  2. In the absence of damage/loss or any outstanding tolls/fines, said deposit shall be credited toward payment of the rental fee and any excess shall be returned to the renter after two weeks from the date of return of the vehicle.
Mileage Limit
Renter will obey the mileage limit for the Vehicle as written in agreement.
Existing Damage to Vehicle
The Parties acknowledge the existing damage to the Vehicle as notated above in contract.
Insurance
  1. The Waryam Singh Pty Ltd will provide the renter with compulsory third party insurance covering up to $25 million Public Liability.
  2. The Renter hereby warrants to Waryam Singh Pty Ltd that Renter possess insurance that covers personal injury to Renter.
Indemnity
Regardless of insurance coverage, Renter shall fully indemnify the Waryam Singh Pty Ltd for any loss, damage, and legal actions, including reasonable attorney’s fees that Waryam Singh Pty Ltd suffers due to Renter’s use of Vehicle during the term of this Agreement, including but not limited to, damage to the Vehicle, damage to the property of others, injury to Renter, and injury to others. This provision survives till the termination of this Agreement.
Waryam Singh Pty Ltd warranty
The Waryam Singh Pty Ltd represents that to the best of his knowledge and belief that the Vehicle is in sound and safe condition and free of any known faults or defects that would affect its safe operation under normal use.
Renter Warranties: The Renter agrees that Renter
  1. Renter will not allow any other person to operate the Vehicle.
  2. Renter will not operate the Vehicle/ No. Plate in violation of any laws or for an illegal purpose and that if Renter does, Renter is responsible for all associated, tickets, fines, and fees.
  3. Renter will not use the Vehicle to push or tow another vehicle.
  4. Renter will not use the Vehicle for any race or competition.
  5. Renter will not operate the vehicle in a negligent manner.
Renter Responsibilities
  1. Renter is responsible to pay all fines/ tolls issued related to vehicle/ No. Plate during their specified rental period.
  2. Immediately notify us about any change of address, phone number of Renter.
  3. Renter will bring car for due service as per service sticker on the windscreen.
  4. Car must not over heat, should notify us immediately
  5. In case of car keys lost or left in the car, it will cost to the Renter to recover it.
  6. Any damage due to low fuel/ wrong fuel, Renter will pay for all the repair.
  7. Its renter’s responsibility to keep car clean, if there is damage to car paint due to their negligence, Renter will pay for the repair.
Arbitration
In the event that the Parties cannot amicably resolve a dispute or damage claim resulting from this Agreement, the Parties agree to resolve any such dispute or damage claim by arbitration. The arbitration proceeding shall be conducted in [City: Melbourne], [State: Victoria], in accordance with the rules of the Australian Arbitration Association then in effect with one (1) arbitrator to be selected by mutual agreement of the Parties. If the Parties cannot agree on an arbitrator, then the Australian Arbitration Association shall select an arbitrator from the National Panel of Arbitrators. The laws of the State of [State: Victoria] in the Australia shall apply to the arbitration proceedings. The Parties agree that the arbitrator cannot award punitive damages to either Party and agree to be bound by the arbitrator’s findings. Judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction.
General
This Agreement, including all Exhibit(s), constitutes the entire agreement between the Parties in connection with the subject matter hereof and supersedes all agreements, proposals, representations and other understandings, oral or written, of the Parties and any current or subsequent purchase order(s) provided by Affiliate.
No alteration or modification of this Agreement or any Exhibits shall be valid unless made in writing and signed by an authorized Affiliate of each Party. The waiver by either Party of a breach of any provision of the Agreement shall not operate or be construed as a waiver of any subsequent breach and any waiver must be in writing and signed by an authorized Affiliate of the Parties hereto.
If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Any notice or other communication required or permitted hereunder shall be given in writing to the other Party at the address stated above, or at such other address as shall be given by either Party to the other in writing. Any terms of this Agreement which by their nature extend beyond its termination remain in effect until fulfilled, and apply to respective successors and rightful assignees.
If the rent becomes due for more than two weeks the car will be reported as stolen to police and legal action will be taken against the renter.
Waryam Singh Pty Ltd will take legal action against the renter if there is any rent in arrears and the Legal cost will be passed onto the renter.
